בשעה שבני אדם נכנסים. ביום. ולא שיטריחהו לעמוד בלילה:
זה עושה לו פותחת. שלא יגנוב בעה״ב ממי בורו. ובעל הבית עושה לו פותחת אחרת באותו פתח הפתוח לבור, שלא יוכל לבא לשאוב בלא דעת בעל הבית, ולא יבא לעולם בביתו של בעה״ב אא״כ ישנו לבעל הבית בביתו. ומשום חשד אשתו תקנו כן:

מי שיש לו בור. דוקא נקט בור. דאילו חדר דרכו לכנוס שם בין ביום בין בלילה. נ"י. וכתב הרשב"ם מי שיש לו בור וכו' על ידי חלוקה או שלקחו מבעל הבית. ולקח גם הדרך. ע"כ. ומשום חלוקה נקט ולקח. דקיימא לן אחין שחלקו אין להם דרך זה על זה כמ"ש בטור ח"מ סימן קע"ג. אבל בקנה. הא קיימא לן כר"ע במ"ב פ"ד דיש לו דרך ממילא:
וזה עושה לו פותחת. פירש הר"ב בעל הבית וכו' ומשום חשד אשתו תקנו כן כדאמרינן בגמרא וכתב הרשב"ם דמשום גניבה שלא יגנוב חפציו של בעל הבית לא חיישינן שהאשה משמרת את הבית ע"כ. וחשד אשתו פירש נ"י שהרואים אותו נכנס בלא רשות תמיד אפשר יוציאו לעז על אשתו ויבואו לחשדה:

If he had a cistern behind his fellow’s house, he may go in and out only at the time when others are accustomed to go in and out. And he may not bring in his cattle and let them drink from his cistern, rather he must draw water and let them drink outside. He and the owner of the house should each make themselves a lock.
